{"id":2452,"date":"2021-11-17T18:04:29","date_gmt":"2021-11-17T18:04:29","guid":{"rendered":"https:\/\/cannabisnow.com\/?p=57692"},"modified":"2021-11-17T18:04:29","modified_gmt":"2021-11-17T18:04:29","slug":"celebrity-drug-bust-in-india-leads-to-questions-about-privacy-civil-rights","status":"publish","type":"post","link":"https:\/\/thcinct.com\/?p=2452","title":{"rendered":"Celebrity Drug Bust in India Leads to Questions About Privacy &amp; Civil Rights"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/thcinct.com\/wp-content\/uploads\/2021\/11\/celebrity-drug-bust-in-india-leads-to-questions-about-privacy-civil-rights.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p>It was lurid news in India when Aryan Khan \u2014 the son of Bollywood superstar Shah Rukh Khan, and a celebrity in his own right \u2014 was detained by the country\u2019s equivalent of the DEA while on a luxury cruise ship headed from Mumbai to the party town of Goa.&nbsp;<\/p>\n<p>In the Oct. 2 raid, agents seized 21 grams of&nbsp;<em><a href=\"https:\/\/cannabisnow.com\/exploring-charas\/\">charas<\/a><\/em>&nbsp;(hashish), 13 grams of cocaine, five grams of mephedrone and 22 pills of MDMA (popularly known as ecstasy). Eight of Khan\u2019s fellow high-class revelers were also taken into custody.&nbsp;&nbsp;<\/p>\n<h4 id=\"h-denied-bail-for-27-days\"><strong>Denied Bail for 27 Days<\/strong><\/h4>\n<p>The nine were locked up in Mumbai, and formally charged the next day with violating several provisions of the Narcotic Drugs &amp; Psychotropic Substances Act. This was despite the fact that no drugs were actually found on&nbsp;Khan.&nbsp;<\/p>\n<p>The Narcotics Control Bureau (<a href=\"https:\/\/narcoticsindia.nic.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">NCB<\/a>) said they had been eavesdropping on his WhatsApp chats and found evidence that Khan was a \u201cregular user of contraband,\u201d and might even be involved in international drug trafficking. On this basis, he was denied bail.<\/p>\n<blockquote class=\"instagram-media\" data-instgrm-captioned data-instgrm-permalink=\"https:\/\/www.instagram.com\/p\/CSl5H1Tqrun\/?utm_source=ig_embed&amp;utm_campaign=loading\" data-instgrm-version=\"14\"><\/blockquote>\n<p>Khan\u2019s powerhouse dad lined up India\u2019s former Attorney General Mukul Rohatgi for his defense team, but the special anti-drug chamber of the&nbsp;<a href=\"https:\/\/bombayhighcourt.nic.in\/index.php\" target=\"_blank\" rel=\"noreferrer noopener\">Bombay High Court<\/a>&nbsp;kept on&nbsp;<a href=\"https:\/\/www.outlookindia.com\/website\/story\/entertainment-news-the-entire-timeline-of-aryan-khan-drug-case\/399137\" target=\"_blank\" rel=\"noreferrer noopener\">refusing to grant bail<\/a>&nbsp;until Oct. 30. Khan and his fellow arrestees each had to put up a bond of 100,000 rupees (approximately $1350) and surrender their passports.&nbsp;<\/p>\n<p>Khan&nbsp;<a href=\"https:\/\/www.womansera.com\/aryan-khan-if-found-guilty-what-may-be-the-sentence-under-indian-law-exclusive\/\" target=\"_blank\" rel=\"noreferrer noopener\">could face 10 years<\/a>&nbsp;in prison if convicted.&nbsp;<\/p>\n<p>And the case has spawned a secondary investigation by Mumbai prosecutors into claims that NCB agents&nbsp;<a href=\"https:\/\/www.ndtv.com\/india-news\/aryan-khan-case-witness-sam-dsouza-claims-he-helped-return-rs-50-lakh-taken-from-shah-rukh-khans-manager-2611340\" target=\"_blank\" rel=\"noreferrer noopener\">tried to shake down<\/a>&nbsp;Shah Rukh Khan\u2019s manager Pooja Dadlani for a bribe to release the younger Khan without bringing charges. Dadlani has been summoned to testify in this case but has twice failed to appear.&nbsp;<\/p>\n<h4><strong>Other High-Profile Busts&nbsp;<\/strong><\/h4>\n<p>This is but one of&nbsp;<a href=\"https:\/\/indianexpress.com\/article\/cities\/mumbai\/ncb-sit-sameer-khan-aryan-khan-armaan-kohli-7622898\/\" target=\"_blank\" rel=\"noreferrer noopener\">several cases<\/a>&nbsp;in the headlines now that are shaking India\u2019s elite. Another concerns the son-in-law of none other than the chief of the NCB, Nawab Malik, who is also a minister in the government of Maharashtra state, the second most populous state in India. The son-in-law, Sameer Khan, was arrested in Jan. in connection with a raid on a private home in an upscale Mumbai suburb that turned up almost 200 kilograms of cured cannabis.&nbsp;<\/p>\n<p>Sameer Khan wasn\u2019t present at the raided house, but was nonetheless&nbsp;<a href=\"https:\/\/www.hindustantimes.com\/cities\/mumbai-news\/200kg-marijuana-seizure-case-ncb-files-1-100-page-charge-sheet-101625854770919.html\" target=\"_blank\" rel=\"noreferrer noopener\">promptly charged<\/a>&nbsp;with conspiracy to traffic on the basis of his WhatsApp chats. He was finally&nbsp;<a href=\"https:\/\/timesofindia.indiatimes.com\/city\/mumbai\/drugs-case-special-court-grants-bail-to-sameer-khan-son-in-law-of-maharashtra-minister-nawab-malik\/articleshow\/86559123.cms\" target=\"_blank\" rel=\"noreferrer noopener\">granted bail<\/a>&nbsp;of 50,000 rupees on Sept. 27, and faces a maximum term of 20 years if convicted.&nbsp;<\/p>\n<p>Interestingly, authorities said the 200 kilos were imported into the country. Although India is a major cannabis producer, with a&nbsp;<a href=\"https:\/\/indianexpress.com\/article\/research\/cannabis-in-india-a-rather-long-story-with-its-highs-and-lows-6592020\/\" target=\"_blank\" rel=\"noreferrer noopener\">millennia-long tradition<\/a>&nbsp;of&nbsp;<a href=\"https:\/\/www.buzzfeednews.com\/article\/tasneemnashrulla\/22-incredible-images-of-a-hindu-festival-where-holy-men-smok\" target=\"_blank\" rel=\"noreferrer noopener\">spiritual use of the plant<\/a>, Canadian hydroponic is said to be all the rage among the country\u2019s fashionable classes, with authorities&nbsp;<a href=\"https:\/\/timesofindia.indiatimes.com\/city\/chennai\/cannabis-from-canada-seized-in-chennai\/articleshow\/81173728.cms\" target=\"_blank\" rel=\"noreferrer noopener\">clocking recent large seizures<\/a>&nbsp;of the stuff.<\/p>\n<p>And in yet more grist for India\u2019s yellow-press mill,&nbsp;<a href=\"https:\/\/www.imdb.com\/name\/nm0997253\/\" target=\"_blank\" rel=\"noreferrer noopener\">actor<\/a>&nbsp;Armaan Kohli, the son of&nbsp;<a href=\"https:\/\/www.imdb.com\/name\/nm0463319\/bio?ref_=nm_ov_bio_sm\" target=\"_blank\" rel=\"noreferrer noopener\">legendary Bollywood producer<\/a>&nbsp;Rajkumar Kohli, was arrested by NCB agents in August for possession of 1.2 grams of cocaine. He is being&nbsp;<a href=\"https:\/\/www.indiatoday.in\/india\/story\/armaan-kohli-bail-plea-bombay-hc-drugs-case-parents-insufficient-evidence-1869312-2021-10-25\" target=\"_blank\" rel=\"noreferrer noopener\">denied bail<\/a>&nbsp;by a Mumbai court while the NCB investigates trafficking charges against him \u2014 again on the basis of his WhatsApp chats.<\/p>\n<h4><strong>Privacy and Civil Rights Concerns&nbsp;<\/strong><\/h4>\n<p>Although these cases have won attention because they have ensnared scions of India\u2019s elite, they raise issues that are of concern to the common people in a country where political space has been closing under seven years of right-wing rule. &nbsp;<\/p>\n<p>It has been&nbsp;<a href=\"https:\/\/thewire.in\/society\/aryan-khan-and-indias-addiction-to-the-drug-called-majoritarianism\" target=\"_blank\" rel=\"noreferrer noopener\">speculated<\/a>&nbsp;that Aryan Khan was targeted because he belongs to a prominent Muslim family that has failed to line up with the Hindu-fundamentalist government of Prime Minister Narendra Modi. Bollywood has been&nbsp;<a href=\"https:\/\/thewire.in\/film\/bollywood-target-right-wing-groups-hinduphobia-tandav\" target=\"_blank\" rel=\"noreferrer noopener\">much criticized<\/a>&nbsp;by the \u201cHindutva\u201d right for supposedly eroding traditional values in much the same terms that Christian fundamentalists lambast Hollywood in the United States.&nbsp;<\/p>\n<p>Aryan Khan\u2019s case has also brought public attention to how a citizen may remain locked up for a significant period without any conviction \u2014 even one from a wealthy family that can afford to put up bail. A full 70% of those behind bars in India are in pre-trial detention. At the end of 2019, more than a&nbsp;<em>lakh<\/em>&nbsp;(100,000) had been in prison awaiting trial for more than a year,&nbsp;<a href=\"https:\/\/www.thehindu.com\/data\/data-70-prisoners-in-india-are-undertrials\/article32569643.ece\" target=\"_blank\" rel=\"noreferrer noopener\">The Hindu<\/a>&nbsp;newspaper reported last year.<\/p>\n<p>And then there\u2019s the question of police surveillance in the digital age, in which every communication leaves an indelible record.
