Lawmakers were then obligated to enact the policy change but have since been unable to reach a consensus on legislation to put in place regulations for a marijuana program.<\/p>\n<p>At the request of legislators, the court agreed to extend its deadline for Congress to formally end prohibition on multiple occasions. But because of the&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-lawmakers-fail-to-legalize-marijuana-ahead-of-supreme-court-deadline\/\" target=\"_blank\" rel=\"noopener\">repeated failed attempts to meet those deadlines<\/a>, justices&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexicos-supreme-court-strikes-down-marijuana-prohibition-after-lawmakers-fail-to-act\/\" target=\"_blank\" rel=\"noopener\">ultimately voted to end criminalization on their own<\/a>&nbsp;in June.<\/p>\n<p>Monreal previously said that&nbsp;the stage is set for lawmakers to&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/top-mexican-senator-lays-out-next-steps-for-national-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">actually pass a marijuana legalization bill<\/a>&nbsp;during the new session after multiple attempts in recent years fell short of getting over the finish line.<\/p>\n<p>Under the draft bill that\u2019s currently being circulated, adults 18 and older would be allowed to purchase and possess up to 28 grams of marijuana and cultivate up to six plants for personal use.<\/p>\n<p>Members of the Senate Health and Justice Committees were tapped to formulate the draft of a cannabis bill.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"es\" dir=\"ltr\">Es importante recordar que el anteproyecto de regulaci\u00f3n de <a href=\"https:\/\/twitter.com\/hashtag\/cannabis?src=hash&amp;ref_src=twsrc%5Etfw\">#cannabis<\/a> que fue circulado no ha sido presentado oficialmente. Dir\u00eda que es una ley digna de aprobarse con algunos ajustes menores (eliminar posesi\u00f3n simple y restricciones a clubes). <a href=\"https:\/\/twitter.com\/hashtag\/UrgeRegular?src=hash&amp;ref_src=twsrc%5Etfw\">#UrgeRegular<\/a><\/p>\n<p>\u2014 Zara Snapp (@zarasnapp) <a href=\"https:\/\/twitter.com\/zarasnapp\/status\/1463325884786479104?ref_src=twsrc%5Etfw\">November 24, 2021<\/a><\/p>\n<\/blockquote>\n<p>The text of the measure states that the purpose of the reform is to promote \u201cpublic health, human rights and sustainable development\u201d and to \u201cimprove the living conditions of the people who live in the United Mexican States.\u201d<\/p>\n<p>It would further \u201cprevent and combat the consequences of problematic consumption of psychoactive cannabis and contribute to the reduction of the crime incidence linked to drug trafficking, promoting peace, security and individual and community well-being.\u201d<\/p>\n<p>Regulators would be tasked with developing separate rules to regulate cannabis for adult-use, research and industrial production.<\/p>\n<p>The bill would establish a Mexican Institute for the Regulation and Control of Cannabis, which would be a decentralized body under the Ministry of Health. It would also be responsible for issuing licenses, overseeing the program and promoting public education campaigns around marijuana.<\/p>\n<p>Retail licenses would need to be issued within 18 months of the enactment of the law.<\/p>\n<p>In order to \u201ccompensate the damages generated by the prohibition,\u201d the bill states that at least 40 percent of marijuana cultivation licenses would need to go to communities most impacted by cannabis criminalization for at least the first five years of implementation. After that point, at least 20 percent of licenses would need to be reserved for equity applicants.<\/p>\n<p>After the Supreme Court independently invalidated prohibition earlier this year, advocates stressed that the decision underscores the need for legislators to expeditiously pass a measure to implement a comprehensive system of legal and regulated sales. They want to ensure that a market is established that\u2019s equitable, addresses the harms of criminalization on certain communities and promotes personal freedom.<\/p>\n<p>Advocates are pleased to see Senate leadership take seriously the need to establish regulations and provide access to cannabis for adults, but they have identified some provisions as problematic.<\/p>\n<p>For example, possessing more than 200 grams of marijuana could still result in prison time.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"es\" dir=\"ltr\">\u274c Se sigue penalizando la posesi\u00f3n simple, es decir, la posesi\u00f3n para fines de consumo personal (no suministro ni comercio). Esto quiere decir que, si posees m\u00e1s de 200 gramos, puedes ser condenado de 10 meses a 3 a\u00f1os de prisi\u00f3n.<\/p>\n<p>\u2014 M\u00e9xico Unido (@MUCD) <a href=\"https:\/\/twitter.com\/MUCD\/status\/1463277504215470080?ref_src=twsrc%5Etfw\">November 23, 2021<\/a><\/p>\n<\/blockquote>\n<p>Senate President Olga S\u00e1nchez Cordero, who previously served at a cabinet-level position in President Andr\u00e9s Manuel L\u00f3pez Obrador\u2019s administration, recently said that \u201cthere is <a href=\"https:\/\/www.marijuanamoment.net\/top-mexican-senator-says-marijuana-legalization-bill-may-be-taken-up-within-weeks\/\" target=\"_blank\" rel=\"noopener\">no longer room for the prohibitionist policy.<\/a>\u201d And she also says the influence of the <a href=\"https:\/\/www.marijuanamoment.net\/top-mexican-senator-blames-u-s-for-marijuana-criminalization-ahead-of-legalization-vote-expected-next-month\/\" target=\"_blank\" rel=\"noopener\">U.S. is to blame for failed marijuana criminalization laws<\/a> in her country.<\/p>\n<p>The Senate approved a legalization bill late last year, and then the Chamber of Deputies&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexicos-chamber-of-deputies-approves-revised-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">made revisions and passed it in March<\/a>, sending it back to the originating chamber. A couple of Senate committees then&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexico-marijuana-legalization-bill-advances-in-senate-for-second-day-in-a-row\/\" target=\"_blank\" rel=\"noopener\">took up and cleared the amended measure<\/a>, but leaders quickly started signaling&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-senators-seek-yet-another-extension-of-marijuana-legalization-deadline\/\" target=\"_blank\" rel=\"noopener\">that certain revisions made the proposal unworkable<\/a>.<\/p>\n<p>After the Chamber of Deputies previously approved the Senate-passed legalization bill, senators said that the revised proposal was critically internally conflicted\u2014on provisions concerning legal possession limits, the definition of hemp and other issues\u2014and lawmakers themselves could be subject to criminal liability if it went into effect as drafted.<\/p>\n<p>But Monreal said in April that if the court were to make a declaration of unconstitutionality before a measure to regulate cannabis was approved, it would result in \u201cchaos.\u201d<\/p>\n<p>The top senator also talked about the importance of lawmakers taking their time to craft good policy and not rush amidst lobbying from tobacco and pharmaceutical industry interests.<\/p>\n<p>\u201cWe must not allow ourselves to be pressured by interests,\u201d he said at the time. \u201cThe Senate must act with great prudence in this matter.\u201d<\/p>\n<p>Sen. Eduardo Ram\u00edrez Aguilar of the MORENA party said in April that \u201cat this time,&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-senate-will-pass-marijuana-legalization-bill-as-revised-by-deputies-top-lawmaker-says\/\" target=\"_blank\" rel=\"noopener\">it is important to legislate in the terms that are presented to us<\/a>\u201d and then consider additional revisions to cannabis laws through subsequent bills.<\/p>\n<p>That\u2019s the position many legalization advocates took as well, urging lawmakers to pass an imperfect bill immediately and then work on fixing it later.<\/p>\n<p>Mexico\u2019s president said in December that a vote on legalization legislation was <a href=\"https:\/\/www.marijuanamoment.net\/mexican-president-says-marijuana-legalization-bill-delayed-due-to-mistakes-in-text\/\" target=\"_blank\" rel=\"noopener\">delayed due to minor \u201cmistakes\u201d in the proposal<\/a>.<\/p>\n<p>The legalization bill&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-senate-committees-formally-approve-marijuana-legalization-bill-for-full-floor-action\/\" target=\"_blank\" rel=\"noopener noreferrer\">cleared a joint group of Senate committees<\/a>&nbsp;prior to the full floor vote in that chamber last year, with some amendments being made after members informally&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-senate-committees-approve-marijuana-legalization-bill-with-floor-vote-planned-next-week\/\" target=\"_blank\" rel=\"noopener noreferrer\">considered and debated the proposal<\/a>&nbsp;during a virtual hearing.<\/p>\n<p>Members of the Senate\u2019s Justice, Health, and Legislative Studies Committees had&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-senate-committees-advance-marijuana-legalization-bill-to-floor-vote\/\" target=\"_blank\" rel=\"noopener noreferrer\">approved a prior version of legal cannabis legislation<\/a>&nbsp;last year as well, but the pandemic delayed consideration of the issue. Sen. Julio Ram\u00f3n Menchaca Salazar of the MORENA party said in April that legalizing cannabis could&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-lawmakers-set-to-take-up-marijuana-legalization-bill-with-focus-on-economic-recovery\/\" target=\"_blank\" rel=\"noopener noreferrer\">fill treasury coffers at a time when the economy is recovering from the health crisis<\/a>.<\/p>\n<p>As lawmakers work to advance the reform legislation, there\u2019s been a more lighthearted push to focus attention on the issue by certain members and activists. That push has mostly involved planting and gifting marijuana.<\/p>\n<p>Late last year, S\u00e1nchez Cordero, then a top administration official, was&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-cabinet-member-accepts-gifted-marijuana-plant-as-lawmakers-prepare-legalization-vote\/\" target=\"_blank\" rel=\"noopener noreferrer\">gifted a cannabis plant by senator<\/a>&nbsp;on the Senate floor, and she said she\u2019d be making it a part of her personal garden.<\/p>\n<p>A different lawmaker&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/mexican-cabinet-member-accepts-lawmakers-marijuana-gift-during-legislative-meeting\/\" target=\"_blank\" rel=\"noopener noreferrer\">gave S\u00e1nchez Cordero, a marijuana joint<\/a>&nbsp;on the floor of the Chamber of Deputies in 2019. That joint is now framed and hangs in her office.<\/p>\n<p>Cannabis made another appearance in the legislature last year, when Sen.
