Defenders of Delta-8<br \/>\nargue that because it is &#8220;derived from hemp&#8221;, it is legal<br \/>\nunder the Farm Bill. Opponents point out that Delta-8 is a<br \/>\nderivative of cannabis that has psychoactive effects and argue that<br \/>\n\u2013 because it appears in the plant in such small quantities<br \/>\n\u2013 it&#8217;s just the byproduct of an unforeseen chemical<br \/>\nalteration to hemp, which is not what the 2018 Farm Bill was meant<br \/>\nto authorize.&nbsp;&nbsp;In other words, Delta-8 walks, talks and<br \/>\nsmells like cannabis, and should therefore qualify as marijuana for<br \/>\nthe purposes of the Controlled Substances Act and should be subject<br \/>\nto the same state and local regulatory requirements as Delta-9<br \/>\nTHC.&nbsp;<br \/>&nbsp;<br \/>As with all things cannabis, the question of how to deal with the<br \/>\nsale and regulation of Delta-8 varies state to<br \/>\nstate.&nbsp;&nbsp;Most states are currently taking a &#8220;ban it<br \/>\nnow, and study it later&#8221; approach \u2013 as fifteen states<br \/>\nhave already taken steps to restrict or ban Delta-8, including New<br \/>\nYork, Connecticut, Colorado, Washington, and<br \/>\nVermont.&nbsp;&nbsp;Meanwhile, six other states, including Michigan<br \/>\nand Illinois, are considering legislative bans. New York recently<br \/>\nupdated their draft regulations for the manufacturing, processing<br \/>\nand sale of &#8220;cannabinoid hemp&#8221; products<br \/>\n(<em>i.e.&nbsp;<\/em> CBD) \u2013 which have yet to go into effect<br \/>\n\u2013 to prohibit processors from using &#8220;synthetic<br \/>\ncannabinoids or Delta-8-THC created through isomerization, in the<br \/>\nextraction or manufacturing of any cannabinoid hemp<br \/>\nproducts.&#8221;&nbsp;&nbsp;In short, New York appears poised to<br \/>\nclose the loophole that allowed Delta-8 to escape regulatory<br \/>\noversight for years.<br \/>&nbsp;<br \/>With states continuing to ban or restrict the production and sale<br \/>\nof Delta-8, it is likely that federal regulators will have to<br \/>\nspecifically address the topic in the near future to clear up the<br \/>\ncurrent confusion.&nbsp;&nbsp;In the meantime, it will fall to the<br \/>\nstates to decide when and how Delta-8 can be sold (if at<br \/>\nall).&nbsp;&nbsp;Be sure to check out our That&#8217;s Just Your<br \/>\nOpinion Man section below for an explanation of why that&#8217;s so<br \/>\nimportant to the cannabis industry as a whole.&nbsp;<\/p>\n<p><em>The content of this article is intended to provide a general<br \/>\nguide to the subject matter.
