{"id":3071,"date":"2021-12-16T11:31:10","date_gmt":"2021-12-16T11:31:10","guid":{"rendered":"http:\/\/CAIiEDP3n0MXGqVMh-PMZuEHdoIqGQgEKhAIACoHCAow3cCjCzCgy7sDMKy5hAc"},"modified":"2021-12-16T11:31:10","modified_gmt":"2021-12-16T11:31:10","slug":"cannabis-businesses-not-immune-from-vaccine-mandate-controversy-marijuana-business-daily","status":"publish","type":"post","link":"https:\/\/thcinct.com\/?p=3071","title":{"rendered":"Cannabis businesses not immune from vaccine-mandate controversy &#8211; Marijuana Business Daily"},"content":{"rendered":"<div class=\"image-full\">\n<div class=\"bialty-container\"><img loading=\"lazy\" decoding=\"async\" width=\"1182\" height=\"720\" src=\"https:\/\/thcinct.com\/wp-content\/uploads\/2021\/12\/cannabis-businesses-not-immune-from-vaccine-mandate-controversy-marijuana-business-daily.webp\" class=\"attachment-full size-full wp-post-image\" alt=\"Image depicting a COVID-19 vaccination\"><\/div>\n<\/div>\n<div class=\"article-content\">\n<div class=\"bialty-container\">\n<p>Most U.S. employers already require their employees to get vaccinated against COVID-19 or have plans to require them to do so soon.<\/p>\n<p>That\u2019s according to a <a href=\"https:\/\/www.willistowerswatson.com\/en-US\/News\/2021\/11\/over-half-of-us-employers-will-require-employee-vaccines-willis-towers-watson-survey-finds\" target=\"_blank\" rel=\"noopener\">recent survey<\/a> conducted by London-headquartered insurance broker and advisory firm Willis Towers Watson.<\/p>\n<p class=\"ad-header hide-for-small-only\">Advertisement<\/p>\n<div id=\"in-article-ad-468595522\" class=\"in-article-ad\"> <\/div>\n<p>But vaccine mandates aren\u2019t so popular among cannabis employers, most of whom are too small to face government directives.<\/p>\n<p>Cannabis employers that are following vaccine-or-test rules often say they are simply following vaccine decrees required by state and local regulators.<\/p>\n<p>The reluctance to impose a vaccine-or-test regimen likely reflects a libertarian streak that\u2019s unsurprising in an industry that often flouts federal law and attracts consumers skeptical of traditional pharmaceuticals and the companies that make them.<\/p>\n<p>\u201cI left it up to my employees,\u201d said Luis Vega, owner of Wepa Farms, a hemp company in North Haven, Connecticut, with about 25 employees.<\/p>\n<p>\u201cMost of our staff and everybody that works with us is pretty open-minded to understand that we all make individual choices and individual ideas on what we want to do.\u201d<\/p>\n<p>According to an informal online poll of more than 300 retail store owners conducted by <em>MJBizDaily<\/em>, 60% said they would not implement employee vaccine mandates.<\/p>\n<p>Only 31% said they were requiring them, while the rest had not yet settled on a plan.<\/p>\n<p><strong>Business dilemma<\/strong><\/p>\n<p>The controversy over employer vaccine mandates is far from limited to the cannabis industry.<\/p>\n<p>Even as most private employers now require or are planning to require their employees to get vaccinated, employers also worry that mandates will scare off employees in an already tight labor market made even more constricted by the pandemic.<\/p>\n<div class=\"columns large-12 medium-12 small-12 con_cta_wrapper\">\n<p><b>Grow better: <em>MJBizDaily<\/em> Greenhouse Components Buyers Guide&nbsp;<\/b><\/p>\n<div id=\"lp-pom-text-456\" class=\"lp-element lp-pom-text nlh\">\n<p>Maximize your output and quality with the right equipment. Download the guide to find out and learn more technical jargon unique to greenhouse and the cannabis industry.<\/em><\/li>\n<\/ul><\/div>\n<\/p><\/div>\n<p>Roughly <a href=\"https:\/\/www.kff.org\/coronavirus-covid-19\/press-release\/1-in-4-workers-say-their-employer-required-them-to-get-a-covid-19-vaccine-up-since-june-5-of-unvaccinated-adults-say-they-left-a-job-due-to-a-vaccine-requirement\/\" target=\"_blank\" rel=\"noopener\">5% of unvaccinated adults<\/a> in the United States say they left a job because an employer required them to get vaccinated, with half of all employees reporting opposition to employer mandates, according to Kaiser Family Foundation surveys.<\/p>\n<p>Making matters more complicated for private employers, a federal vaccine mandate for companies with more than 100 employees is tied up in legal challenges while a handful of states controlled by Republican legislators have passed emergency rules forbidding employer vaccine mandates.<\/p>\n<p>Left to sort it all out are employers such as Vince Sanders, owner of Kansas City, Missouri-based CBD American Shaman, a retail chain with more than 300 locations in 38 states.<\/p>\n<p>\u201cWe\u2019ve honestly been so up in the air on that,\u201d Sanders told <em>MJBizDaily<\/em> about requiring employee vaccines.<\/p>\n<p>His company has yet to require COVID-19 vaccines.<\/p>\n<p>\u201cThe vast majority of people are vaccinated,\u201d Sanders said. \u201cI certainly am.<\/p>\n<p>\u201cBut there are a few people that are not, and interestingly enough, as far as I know, they\u2019ve already had COVID. So that\u2019s not an easy call.\u201d<\/p>\n<p><strong>Following requirement rules<\/strong><\/p>\n<p>Some cannabis employers are embracing vaccine requirements, even where they\u2019re not required.<\/p>\n<p>At GenCanna, a CBD manufacturer in Kentucky, executives pointed to safety concerns for requiring their 54 employees to show they\u2019ve been vaccinated.<\/p>\n<p>\u201cSafety is always our highest priority, and that includes the people we employ as well as the products we make,\u201d CEO Andrew Barnett said via email.<\/p>\n<p>\u201cTo ensure that our colleagues work in the safest possible environment, GenCanna instituted a mandatory vaccination requirement in August.<\/p>\n<p>\u201cEvery one of our staff members have adhered to this policy and are fully vaccinated.\u201d<\/p>\n<p>Other cannabis employers are embracing vaccine mandates as a means to ending the pandemic.<\/p>\n<p>\u201cWhatever it takes to get us kind of back to status quo is a good thing,\u201d said Steven Phan, co-founder of Come Back Daily, a store that sells CBD products in New York City.<\/p>\n<p>New York City officials have ordered proof of vaccination for most public indoor activities while New York state officials this week mandated that anyone older than 2 wear a mask in indoor public spaces without vaccine mandates.<\/p>\n<p>Across town in Brooklyn, medical marijuana dispensary manager Adam DeLapp said the 10 employees at his store had no problem complying.<\/p>\n<p>\u201cAll of our employees took it upon themselves and got vaccinated,\u201d said DeLapp, assistant general manager at Be, a dispensary owned by iAnthus Capital.<\/p>\n<p>\u201cI know some people are like, \u2018Oh, you\u2019ve got to have the vaccine,\u2019 and other people say it\u2019s each person\u2019s choice,\u201d DeLapp added.<\/p>\n<p>\u201cBut I want things to get back to normal as soon as possible, without more variants, especially with so many tourists here.<\/p>\n<p>\u201cWe want to make sure we follow the guidelines and people feel safe coming in here, because this is a medical facility.\u201d<\/p>\n<p><strong>Employers\u2019 rights<\/strong><\/p>\n<p>The debate over required vaccinations has underscored the need for cannabis employers to know their rights and responsibilities, said Fabiola Jimenez, an attorney at Cultiva Law in Seattle.<\/p>\n<p>Jimenez said her cannabis clients are asking what to do to get ready for additional vaccine mandates.<\/p>\n<p>\u201cClients are wondering, \u2018Is this going to be something that\u2019s coming down the pipeline?\u2019\u201d she said.<\/p>\n<p>\u201cIt\u2019s an interesting question, because the cannabis industry for many can be considered a very liberal industry, when you compare it to other types of industries. And so you have folks that (say), getting vaccinated, it\u2019s fine.\u201d<\/p>\n<p>But many cannabis business owners tend to be white, conservative men, she points out.<\/p>\n<p>\u201cSo now you have almost this battling perspective where you have employees that we would consider very liberal \u2026 and then you have business owners that are very conservative and would not want to have a vaccine mandate implemented.\u201d<\/p>\n<p>According to the U.S. Equal Employment Opportunity Commission, business owners are legally <a href=\"https:\/\/www.eeoc.gov\/wysk\/what-you-should-know-about-covid-19-and-ada-rehabilitation-act-and-other-eeo-laws\" target=\"_blank\" rel=\"noopener\">allowed to require vaccines<\/a> (subject to legally required exemptions) and to ask about vaccine status.<\/p>\n<p>Still to be settled in court is whether the federal government can require private employers to mandate vaccinations and whether business owners who resist vaccine mandates could be held liable for unsafe working conditions if unvaccinated workers infect colleagues.<\/p>\n<p>But it makes good business sense to be thoughtful about how to communicate vaccine policy to employees, Jimenez said.<\/p>\n<p>\u201cIt\u2019s important to have a genuine conversation, not just a simple email,\u201d she said. \u201cCreate a much more personalized interaction. \u2026 If you go in right off the bat and say, \u2018We\u2019re doing the mandate,\u2019 you\u2019re going to polarize folks.\u201d<\/p>\n<p>Jimenez noted that \u201cthe vaccine is already a touchy subject.<\/p>\n<p>\u201cFor some folks,\u201d she said, \u201cit\u2019s a no-brainer, they want to get vaccinated. For other folks, that\u2019s a no-brainer, they don\u2019t want it.<\/p>\n<p>\u201cSo find some way where you can personalize that message.
