The brief reads, \u201cUpholding the supremacy of the designation of cannabis under the CSA [Controlled Substances Act] is futile when the coordinate branches of government have affirmatively promoted and protected state medical cannabis programs. \u2026 [T]he <a href=\"https:\/\/legal-dictionary.thefreedictionary.com\/estoppel\" target=\"_blank\" rel=\"noreferrer noopener\">doctrine of estoppel<\/a> is needed to end the nullification crisis and to protect those who relied on the guidance of federal officials and agencies and engaged in the cannabis industry despite federal illegality.\u201d<\/p>\n<p>David C. Holland, Esq, the Executive and Legal Director of <a href=\"https:\/\/esnorml.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Empire State NORML<\/a> and author of the brief said: \u201cThe United States Supreme Court needs to step in and hear this case to resolve not only the split amongst state supreme courts regarding medical cannabis reimbursement laws, but also whether the Schedule I classification of cannabis under the federal Controlled Substances Act is still enforceable in light of the 25 years of flourishing medical programs in [the majority of] states. Refusing to hear the case not only prolongs that uncertainty, but also provides no definitive answer to the issue of preemption of state medical marijuana laws as a result of that continued Schedule I status.\u201d<\/p>\n<p>In the case in question, <em>Musta v. Mendota Heights Dental Center and Hartford Insurance Group<\/em>, the Minnesota Supreme Court <a href=\"https:\/\/norml.org\/news\/2021\/10\/21\/minnesota-supreme-court-denies-workers-compensation-for-costs-of-medical-marijuana\/\">held<\/a> that employees are ineligible for reimbursement because cannabis remains classified as a Schedule I controlled substance under federal law. That determination is inconsistent with a <a href=\"https:\/\/norml.org\/news\/2021\/04\/15\/new-jersey-supreme-court-affirms-employer-must-reimburse-worker-for-medical-cannabis-expenses\/\">separate ruling<\/a> issued this year by the New Jersey Supreme Court which held that the use of cannabis is eligible for reimbursement under the states\u2019 workers\u2019 compensation laws because both state and federal marijuana laws can \u201ccoexist.\u201d<\/p>\n<p>Currently, five states \u2014 Connecticut,&nbsp;<a href=\"https:\/\/norml.org\/news\/2019\/03\/14\/new-hampshire-high-court-rules-medical-cannabis-costs-reimbursable\/\">New Hampshire<\/a>,&nbsp;<a href=\"https:\/\/norml.org\/news\/2021\/04\/15\/new-jersey-supreme-court-affirms-employer-must-reimburse-worker-for-medical-cannabis-expenses\/\">New Jersey<\/a>, New Mexico, and New York \u2013 explicitly allow for employees to have their medical cannabis expenses reimbursed.
