The <a href=\"https:\/\/twitter.com\/RockefellerInst?ref_src=twsrc%5Etfw\">@RockefellerInst<\/a> will continue to update the marijuana opt out tracker as needed. <a href=\"https:\/\/t.co\/UXzxrUnGYo\">https:\/\/t.co\/UXzxrUnGYo<\/a><\/p>\n<p>\u2014 Heather Trela (@HeatherTrela) <a href=\"https:\/\/twitter.com\/HeatherTrela\/status\/1476966321350971403?ref_src=twsrc%5Etfw\">December 31, 2021<\/a><\/p>\n<\/blockquote>\n<p>Municipalities that don\u2019t proactively move to ban the businesses on at least a temporary basis will default to an indefinite opt-in.<\/p>\n<p>To that end, it\u2019s important to note that the numbers on opt-outs doesn\u2019t necessarily reflect a local government\u2019s position on marijuana legalization overall. As in New Jersey, where a majority of cities have <a href=\"https:\/\/www.marijuanamoment.net\/why-most-new-jersey-municipalities-are-banning-marijuana-shops-despite-overwhelming-public-support\/\" target=\"_blank\" rel=\"noopener\">initially chosen not to permit retailers<\/a> following the reform implementation, some New York municipalities have simply decided to opt-out for now ahead of the deadline so that they have more time to prepare and craft local rules.<\/p>\n<p>\u201cThe big takeaway for me is how frequently the lack of state guidelines was cited by municipalities that chose to opt out,\u201d Heather Trela, who has tracked local cannabis decisions for the Rockefeller Institute, told Marijuana Moment. \u201cWhich potentially leaves the door open for some to opt in in the future.\u201d<\/p>\n<p>\u201cWe will continue to follow up with municipalities directly to hopefully get more info, especially from towns and villages that don\u2019t have a website,\u201d she said.<\/p>\n<p>It\u2019s also the case that while dispensaries and social consumption sites can be locally banned in New York, other cannabis business license types are exempt from the opt-out option, including cultivators and delivery services.<\/p>\n<p>Because the implementation process to allow retailers has been drawn out, one GOP senator said he wanted to give local jurisdictions another year to decide <a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-wants-to-give-cities-more-time-to-ban-marijuana-businesses-as-regulations-develop\/\" target=\"_blank\" rel=\"noopener\">whether they will opt out of allowing marijuana businesses<\/a> to operate in their area\u2014a proposal that advocates said was unnecessary and would create undue complications for the industry. It did not advance in the legislature.<\/p>\n<p>As the state prepares to launch the first retail marijuana shops, the law signed by former Gov. Andrew Cuomo (D) already permits adults 21 and older to <a href=\"https:\/\/www.marijuanamoment.net\/cops-cant-arrest-you-for-smoking-marijuana-on-sidewalks-nypd-says-in-post-legalization-memo\/\" target=\"_blank\" rel=\"noopener\">possess and publicly consume cannabis<\/a>. And other lawmakers are working to build upon the legalization policy.<\/p>\n<p>For example, a New York senator filed a bill last month to make it so that gay, lesbian and bisexual people can <a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-bill-to-extend-marijuana-equity-benefits-to-gay-lesbian-and-bisexual-people\/\" target=\"_blank\" rel=\"noopener\">qualify as social equity applicants<\/a> under the state\u2019s marijuana law.<\/p>\n<p>Sen. Jeremy Cooney (D) introduced the legislation, shortly after filing a separate bill to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-bill-to-extend-marijuana-equity-benefits-to-transgender-and-non-binary-people\/\" target=\"_blank\" rel=\"noopener\">include transgender and non-binary people<\/a>&nbsp;in the cannabis social equity program. Kathy Hochul (D), who replaced Cuomo after he resigned amid a sexual harassment scandal, has repeatedly emphasized her interest in <a href=\"https:\/\/www.marijuanamoment.net\/getting-new-york-marijuana-legalization-rolling-is-a-priority-new-governors-office-says\/\" target=\"_blank\" rel=\"noopener\">efficiently implementing the legalization law<\/a>.<\/p>\n<p>At a recent event, she touted the fact that&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-says-marijuana-legalization-will-create-thousands-of-jobs-and-touts-regulatory-appointments\/\" target=\"_blank\" rel=\"noopener\">she had quickly made regulatory appointments<\/a>&nbsp;that had been delayed under her predecessor. \u201cI believe there\u2019s thousands and thousands of jobs\u201d that could be created in the new industry, the governor said.<\/p>\n<p>Meanwhile, New York\u2019s Cannabis Control Board (CCB)&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulators-hold-first-legalization-implementation-meeting-and-approve-patient-access-to-flower-cannabis\/\" target=\"_blank\" rel=\"noopener\">held its first meeting in October<\/a>, a key step toward implementing the state\u2019s adult-use marijuana program.<\/p>\n<p>Members of the board, who were&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulatory-board-is-officially-completed-with-governors-final-appointments\/\" target=\"_blank\" rel=\"noopener\">appointed by the governor and legislative leaders<\/a>, announced that medical marijuana dispensaries will be allowed to sell flower cannabis products to qualified patients. The $50 registration fee for patients and caregivers was also permanently waived.<\/p>\n<p>In November, regulators also <a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulators-approve-rules-for-hemp-flower-sales-delta-8-thc-and-more\/\" target=\"_blank\" rel=\"noopener\">approved rules for the state\u2019s cannabinoid hemp program<\/a>, notably clarifying that flower from the crop can be sold but delta-8 THC products are currently prohibited from being marketed.<\/p>\n<p>The state comptroller recently projected that New York stands to eventually&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/new-york-will-generate-245-million-in-marijuana-revenue-annually-by-2024-state-official-estimates\/\" target=\"_blank\" rel=\"noopener\">generate $245 million in annual marijuana revenue<\/a>, which they say will help&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/new-york-officials-say-marijuana-tax-revenue-will-help-fill-budget-gap-from-declining-cigarette-sales\/\" target=\"_blank\" rel=\"noopener\">offset losses from declining tobacco sales<\/a>.<\/p>\n<p>For the first year of cannabis sales, the state is expected to see just $20 million in tax and fee collections. That will be part of an estimated $26.7 billion in new revenues that New York is expected to generate in fiscal year 2021-2022 under a budget that the legislature passed in April.<\/p>\n<p>The state Department of Labor separately announced in recent guidance that New York employers are no longer allowed to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-employers-cant-drug-test-most-workers-for-marijuana-state-announces\/\" target=\"_blank\" rel=\"noopener\">drug test most workers for marijuana<\/a>.<\/p>\n<p>Meanwhile, a New York lawmaker introduced a bill in June that would require the state to establish an institute to&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-would-create-state-sponsored-psychedelics-research-institute\/\" target=\"_blank\" rel=\"noopener\">research the therapeutic potential of psychedelics<\/a>.<\/p>\n<p>Another state legislator filed legislation last month to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmaker-files-bill-to-legalize-medical-psilocybin-treatments-with-focus-on-first-responders-and-veterans\/\" target=\"_blank\" rel=\"noopener\">legalize psilocybin mushrooms for medical purposes<\/a>&nbsp;and establish facilities where the psychedelic could be grown and administered to patients.<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"yHw61eWcjl\">\n<p><a href=\"https:\/\/www.marijuanamoment.net\/indiana-marijuana-legalization-and-regulatory-bills-pre-filed-for-2022-session\/\">Indiana Marijuana Legalization And Regulatory Bills Pre-Filed For 2022 Session<\/a><\/p>\n<\/blockquote>\n<p><em>Photo courtesy of <a href=\"https:\/\/www.flickr.com\/photos\/weedporndaily\/38550960256\/\" target=\"_blank\" rel=\"noopener\">WeedPornDaily<\/a>.<\/em><\/p>\n<div class=\"cb_p6_patreon_button\">\n<p>Marijuana Moment is made possible with support from readers.
