{"id":3568,"date":"2022-01-10T15:58:57","date_gmt":"2022-01-10T15:58:57","guid":{"rendered":"http:\/\/CBMiSmh0dHBzOi8vZmlsdGVybWFnLm9yZy9jYW5uYWJpcy13b3JrZXJzLWluLXN0LWxvdWlzLWFyZS1wb2lzZWQtdG8tdW5pb25pemUv0gEA"},"modified":"2022-01-10T15:58:57","modified_gmt":"2022-01-10T15:58:57","slug":"cannabis-workers-in-st-louis-are-poised-to-unionize-filter","status":"publish","type":"post","link":"https:\/\/thcinct.com\/?p=3568","title":{"rendered":"Cannabis Workers in St. Louis Are Poised to Unionize &#8211; Filter"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/thcinct.com\/wp-content\/uploads\/2022\/01\/cannabis-workers-in-st-louis-are-poised-to-unionize-filter.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p><span class=\"wpsdc-drop-cap\">O<\/span>n January 6, workers at a medical cannabis company in St. Louis, Missouri, filed a petition for what would reportedly be the state\u2019s first cannabis union election. <span class=\"s1\">They\u2019re poised to join <span class=\"s2\">a <\/span><a href=\"https:\/\/filtermag.org\/marijuana-workers-unions\/\"><span class=\"s2\">growing unionized cannabis workforce<\/span><\/a> across the country.&nbsp;<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Missouri passed medical marijuana legislation back in 2018. On January 6 this year, six employees of the company Swade Cannabis, which operates multiple dispensaries around St. Louis, <a href=\"https:\/\/www.stltoday.com\/news\/local\/marijuana\/cannabis-workers-at-st-louis-medical-marijuana-dispensary-file-for-union-election\/article_a2b09a65-1ae6-5a29-b1f6-5c6c8fd54c4d.html\"><span class=\"s2\">submitted an election petition<\/span><\/a> to company management and to the National Labor Relations Board (NLRB). The proposed bargaining unit would be represented by the <a href=\"https:\/\/ufcw655.org\/\"><span class=\"s2\">United Food and Commercial Workers (UFCW) Local 655.<\/span><\/a> The UFCW represents the most cannabis workers of any union in the United States\u2014<a href=\"https:\/\/ufcw770.org\/workers-at-los-angeles-sweet-flower-cannabis-dispensaries-unionize-with-ufcw\/\"><span class=\"s2\">about 10,000 individuals<\/span><\/a>.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Collin Reischman, director of communications for UFCW Local 655, told <i>Filter<\/i> that one of the union\u2019s roles is to help the workers hold the election after they themselves express interest. The NLRB will meanwhile coordinate with all parties to <a href=\"https:\/\/www.nlrb.gov\/about-nlrb\/what-we-do\/conduct-elections\">set an election date<\/a>. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In a statement provided to <em>Filter<\/em> through Swade Cannabis, Director of Dispensary Operations Jack Haddox said that the company \u201cwill not stand in the way of unionization efforts.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">UFCW will additionally be speaking with workers about what joining a union entails, as well as helping the bargaining unit draft its first contract. <\/span><span class=\"s1\">Reischman described the Swade Cannabis workers\u2019 biggest concerns as fair compensation, job stability and COVID-19 safety in the workplace.&nbsp;<\/span><\/p>\n<blockquote>\n<p><span class=\"s1\">\u201cThey\u2019re assuming a lot of risk. So first and foremost they need to be compensated fairly for that risk.\u201d&nbsp;<\/span><\/p>\n<\/blockquote>\n<p class=\"p1\"><span class=\"s1\">\u201cThese individuals are working directly with patients in a relatively new industry in Missouri, trying to make sure they\u2019re compliant with the law and following rules and regulations, and they\u2019re assuming a lot of risk,\u201d he said. \u201cSo first and foremost they need to be compensated fairly for that risk.\u201d&nbsp;<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He noted that Swade Cannabis <a href=\"https:\/\/www.globenewswire.com\/news-release\/2021\/08\/31\/2289211\/0\/en\/AFC-Gamma-Provides-BeLeaf-Medical-LLC-With-23-Million-Senior-Secured-Credit-Facility-to-Fund-Its-Missouri-Expansion.html\">is growing fast,<\/a> raising investment money and expanding throughout the state. \u201cThose workers have said, \u2018We were some of the first to work for you. We feel as though we should be compensated\u2014especially if you are growing.\u2019\u201d&nbsp;&nbsp;<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Several fully-legalized states, including <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201920200AB1291\">California<\/a>, <a href=\"https:\/\/www.hartfordbusiness.com\/article\/connecticut-law-opens-door-to-unions-in-retail-cannabis-industry\"><span class=\"s2\">Connecticut<\/span><\/a> and <a href=\"https:\/\/www.gothamgazette.com\/games-archive\/130-opinion\/11005-legal-cannabis-marijuana-oopportunity-new-york-state\"><span class=\"s2\">New York<\/span><\/a>, require some or all cannabis businesses to promise not to interfere in union organizing\u2014or <a href=\"https:\/\/www.uschamber.com\/sites\/default\/files\/documents\/files\/laborpeaceagreements.pdf\"><span class=\"s2\">\u201clabor peace\u201d<\/span><\/a> agreements, as they\u2019re known. <a href=\"https:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs5.asp?ActID=3992&amp;ChapterID=35\">Illinois<\/a> and <a href=\"https:\/\/www.businesswire.com\/news\/home\/20220106005635\/en\/Bolstered-by-Union-Support-New-Jersey%E2%80%99s-Licensed-Cannabis-Industry-Delivers-Shovel-to-Sale-Benefits\"><span class=\"s2\">New Jersey<\/span><\/a> offer incentives for employers to sign labor peace agreements. More states <a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/cannabis-industry-peace-laws-spread-fertilizing-union-growth\">may follow this trend<\/a>. After a Rhode Island cannabis dispensary&nbsp;illegally fired a worker in retaliation for organizing, the workers and their local UFCW chapter <a href=\"https:\/\/hightimes.com\/news\/worker-illegally-fired-from-cannabis-company-for-union-involvement-wins-job-back\/\">helped get <\/a>him his job back.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In Virginia, however, Governor-elect Glenn Youngkin <span class=\"s2\">is <\/span><a href=\"https:\/\/www.marijuanamoment.net\/incoming-virginia-gop-governor-wont-overturn-legal-marijuana-possession-but-casts-doubt-on-sales\/\"><span class=\"s2\">trying to undermine labor peace provisions<\/span><\/a> passed under Governor Ralph Northam.<\/span><\/p>\n<blockquote>\n<p><span class=\"s1\">He hopes that Swade Cannabis will keep its promise by <span class=\"s2\">remaining neutral<\/span> and avoiding <span class=\"s2\">union-busting<\/span> tactics.<\/span><\/p>\n<\/blockquote>\n<p class=\"p1\"><span class=\"s1\">Missouri does not require cannabis companies to enter into labor peace agreements\u2014a position which could result in less scrutiny of private employers who interfere in union activity.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Reischman said he hopes that Swade Cannabis will keep its promise by <a href=\"https:\/\/www.nrtw.org\/what-is-a-neutrality-agreement-and-how-does-it-affect-workers\/\"><span class=\"s2\">remaining neutral<\/span><\/a> and avoiding <a href=\"https:\/\/www.laborlab.us\/5_common_union_busting_tactics\"><span class=\"s2\">union-busting<\/span><\/a> tactics to intimidate or coerce workers out of organizing.
