Not anytime&nbsp;soon.<\/p>\n<p>That\u2019s according to a&nbsp;newly proposed zoning update that would prohibit the types of weekly commercial cannabis parties that currently take place in Hamden\u2009\u2014\u2009as part of a&nbsp;broader city effort to define where pot shops should and should not be allowed in the Elm&nbsp;City.<\/p>\n<p>Those marijuana-regulating details are included in a&nbsp;proposed set of city zoning code and map amendments recently submitted by the City Plan Department to the Board of&nbsp;Alders.<\/p>\n<p>The legislative item is included as a&nbsp;communication on the agenda for Tuesday\u2019s Board of Alders meeting. The proposal now heads to the City Plan Commission and one or more aldermanic committees for public hearings and reviews before returning to the full Board of Alders for a&nbsp;final vote.<\/p>\n<p>Click <a href=\"https:\/\/d2f1dfnoetc03v.cloudfront.net\/Files\/2022\/Agenda-Package-for-2-22-22-95-108.pdf\">here <\/a>to read the proposed cannabis-zoning updates in&nbsp;full.<\/p>\n<p>The proposed local cannabis regulations come on the heels of the state\u2019s legalization of recreational marijuana last year as part of the <a href=\"https:\/\/www.cga.ct.gov\/2021\/ACT\/PA\/pdf\/2021PA-00001-R00SB-01201SS1-PA.pdf\">Responsible and Equitable Regulation of Adult-Use Cannabis Act (<span class=\"caps\">RERACA<\/span>)<\/a>, which went into effect on <a href=\"https:\/\/www.cga.ct.gov\/asp\/cgabillstatus\/cgabillstatus.asp?selBillType=Bill&amp;bill_num=SB01201&amp;which_year=2021\">July <span class=\"numbers\">1<\/span>, <span class=\"numbers\">2021<\/span><\/a>. <\/p>\n<p>That law gives Connecticut municipalities a&nbsp;wide latitude to regulate where pot can be bought, sold, grown, and consumed within the borders of their own city or town. As of earlier this month, Connecticut\u2019s Department of Consumer Protection has <a href=\"https:\/\/portal.ct.gov\/DCP\/News-Releases-from-the-Department-of-Consumer-Protection\/2022-News-Releases\/Adult-use-cannabis-applications\">started accepting applications from entrepreneurs looking to get licensed to work in the newly legalized cannabis economy<\/a>.<\/p>\n<p>So, where does the City Plan Department propose allowing New Haven\u2019s legal cannabis economy to&nbsp;grow?&nbsp;<\/p>\n<p>The zoning update would allow cannabis retailers, dispensary facilities, cultivators, and producers to set up shop in business and industrial zones only. Those businesses would need to get a <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>special permit\u201d from the City Plan Commission before they could legally open up&nbsp;shop.&nbsp;<\/p>\n<p>The proposed law would also allow cannabis delivery services and transporters to operate in these districts as of right, with no special permission&nbsp;required.<\/p>\n<p>So, these businesses would be allowed (by special permit or, for delivery services and transporters, as of right) in the <span class=\"caps\">BA<\/span>, <span class=\"caps\">BA<\/span>\u2011<span class=\"numbers\">1<\/span>, <span class=\"caps\">BA<\/span>\u2011<span class=\"numbers\">2<\/span>, <span class=\"caps\">BA<\/span>\u2011<span class=\"numbers\">2<\/span>, <span class=\"caps\">BB<\/span>, <span class=\"caps\">BC<\/span>, <span class=\"caps\">BD<\/span>, <span class=\"caps\">BD<\/span>\u2011<span class=\"numbers\">1<\/span>, <span class=\"caps\">BD<\/span>\u2011<span class=\"numbers\">2<\/span>, <span class=\"caps\">BD<\/span>\u2011<span class=\"numbers\">3<\/span>, <span class=\"caps\">CGD<\/span>, <span class=\"caps\">IL<\/span> or <span class=\"caps\">IH<\/span>&nbsp;zones.<\/p>\n<p>The proposed city law would bar pot shops and associated ventures from opening in any residential zones, or within <span class=\"numbers\">500<\/span>&nbsp;feet of any elementary or secondary schools, or within <span class=\"numbers\">1<\/span>,<span class=\"numbers\">500<\/span>&nbsp;feet of any another cannabis&nbsp;establishment.<\/p>\n<p>It would prohibit the smoking, ingestion or use of cannabis in all <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>indoor public places\u201d such as libraries, bars, restaurants, theaters, shopping malls, and public transportation&nbsp;facilities.<\/p>\n<p>And it would prohibit <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>temporary cannabis events, including but not limited to private marijuana vending events, cannabis trade shows or public cannabis events \u2026 unless authorized by state&nbsp;law.\u201d&nbsp;<\/p>\n<p>That means New Haven would not allow any Elm City version of Hamden\u2019s <a href=\"https:\/\/www.newhavenindependent.org\/article\/high_bazaar_or_bye_bazaar\">popular <\/a>(if <a href=\"https:\/\/www.newhavenindependent.org\/article\/hamden_files_motion_of_contempt_against_high_bazaar\">controversial<\/a>) High Bazaar events, where <a href=\"https:\/\/www.newhavenindependent.org\/article\/potrepreneurs_promise_to_stay_put\">hundreds of people gather every week to buy, sell, trade, and promote cannabis and cannabis-related products while also jamming out to music<\/a>.<\/p>\n<p>The <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>Board of Alders acknowledges that it is in the best interest of the City of New Haven that all cannabis that is cultivated, processed, manufactured, distributed, tested, or sold in the City of New Haven is well-regulated, environmentally responsible, and economically sustainable,\u201d reads one of the <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>Whereas\u201d clauses in the proposed zoning update now before the local&nbsp;legislature.<\/p>\n<p>Another <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>Whereas\u201d clause reads: <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>the Board of Alders seeks to prohibit the commercial cultivation of adult-use cannabis in residential zones and provide locations within commercial and industrial districts where Cannabis may be cultivated, grown, sold, distributed, or&nbsp;dispensed\u201d.<\/p>\n<p>Still another reads: <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>the Board of Alders seeks to protect and preserve peace, order, property and safety of persons as a&nbsp;result of issues associated with Cannabis Establishments, including but not limited to problems with insufficient or improper electrical supply, problems with ventilation leading to mold, offensive odors, or other health hazards and other hazards which are associated with the commercial cultivation of Cannabis within the City of New Haven and which is otherwise often difficult to detect and&nbsp;regulate\u201d.<\/p>\n<p><em>See below for the proposed
