It would limit all forms of THC to under 0.3% by weight. [<a href=\"https:\/\/www.dallasobserver.com\/news\/this-bill-could-ban-delta-8-products-across-the-country-13462113\" target=\"_blank\" rel=\"noreferrer noopener\">Dallas Observer<\/a>; <a href=\"https:\/\/www.marijuanamoment.net\/hemp-could-have-more-thc-under-new-congressional-bill-that-aims-to-fix-regulatory-issues-for-expanding-industry\/\" target=\"_blank\" rel=\"noreferrer noopener\">Marijuana Moment<\/a>]<\/p>\n<p>\u201cMy view of this is that Congress realizes that the existing law is ambiguous, and so they\u2019re clarifying the text to get back to the original intent, which didn\u2019t include legalizing psychoactive substances,\u201d writes one legal expert.<\/p>\n<h3>State news<\/h3>\n<p>An <strong>Alabama<\/strong> lawmaker wants to set an age limit of 18 on D-8. \u201cIt is everywhere,\u201d the lawmaker said of the products in their state. The Alabama Poison Information Center has recorded 116 exposures to delta-8 since March 2021. [<a href=\"https:\/\/www.al.com\/news\/anniston-gadsden\/2022\/02\/alabama-lawmakers-seek-to-regulate-delta-8-thc.html\" target=\"_blank\" rel=\"noreferrer noopener\">AL.com<\/a>]<\/p>\n<p><strong>Arizona<\/strong> lawmakers introduced a legal cannabis industry-backed bill to stop unregulated D-8 from flooding the state, calling it \u201ca rapidly expanding crisis.\u201d The ADA told reporters \u201cRight now, we have operators not understanding what they can and can\u2019t buy, but it has always been our contention that the conversion of hemp is not legal.\u201d [<a href=\"https:\/\/www.tucsonweekly.com\/tucson\/delta-blues-ada-backed-bill-could-have-profound-influence-on-hemp-derived-products-and-business\/Content?oid=31980762\" target=\"_blank\" rel=\"noreferrer noopener\">Tuscon Weekly<\/a>]<\/p>\n<p>Two <strong>Arkansas<\/strong> head shop owners caught a case for D-8 that actually tested 6% delta-9 THC\u2014which is banned in that state. [<a href=\"https:\/\/www.camdenarknews.com\/news\/2022\/feb\/26\/two-local-business-owners-arrested-for-possession\/\" target=\"_blank\" rel=\"noreferrer noopener\">Camden Ark News<\/a>]<\/p>\n<p>Looks like <strong>Indiana<\/strong> will study, not ban D-8 this year. [<a href=\"https:\/\/www.thestatehousefile.com\/politics\/amended-delta-8-bill-would-grant-legal-thc-product-a-reprieve-for-now\/article_07f56aec-95b4-11ec-84ad-8b6c825accf0.html\" target=\"_blank\" rel=\"noreferrer noopener\">The Statehouse File<\/a>]<\/p>\n<p>The state of <strong>Kansas\u2019<\/strong> Johnson County has a March 20 deadline to remove D-8 from store shelves. \u201cDelta-8 THC is a hallucinogenic drug and thus cannot be sold to the public,\u201d Johnson County\u2019s DA stated. [<a href=\"https:\/\/www.kansascity.com\/news\/local\/article258706168.html\" target=\"_blank\" rel=\"noreferrer noopener\">Kansas City<\/a>] <\/p>\n<p><strong>Kentucky<\/strong> lawmakers are ready to throw the book at D-8 and ban all of it, including delta-10, THCO, and THCP. The Kentucky Hemp Association opposes the bill. [<a href=\"https:\/\/www.virginiamercury.com\/2022\/02\/28\/house-gop-kills-bill-to-begin-retail-recreational-marijuana-sales-this-year\/\" target=\"_blank\" rel=\"noreferrer noopener\">Virginia Mercury<\/a>]<\/p>\n<p><strong>Washington state<\/strong> lawmakers have two new bills to ban or tightly regulate delta-8. \u201cThese are being sold right now, without any regulation, without any oversight,\u201d said Democratic Sen. A crackdown looms. [<a href=\"https:\/\/mjbizdaily.com\/as-hemp-thc-sales-boom-cannabis-industry-braces-for-crackdown\/\" target=\"_blank\" rel=\"noreferrer noopener\">MJBizDaily<\/a>]<\/p>\n<p>The <strong>US Hemp Roundtable<\/strong> condemned the selling of synthetic D-9 as hemp. \u201cThis kind of marketing is not simply a threat to public health and safety\u2014particularly for kids that might purchase these products at retail\u2014it undermines the integrity of the legal hemp industry, and ultimately threatens the livelihoods of farmers themselves,\u201d said Ethics Counsel to the U.S. Hemp Roundtable Russell Coleman.
