Zannelli: New policy in line with state mandates.\n<\/p>\n<\/figcaption><\/figure>\n<p>Police commissioners unanimously signed off on a&nbsp;new alcohol and drug policy that adds anabolic steroids to its list of prohibited substances, and that maintains a&nbsp;departmental ban on marijuana use\u2009\u2014\u2009even though the state has newly legalized recreational&nbsp;cannabis.<\/p>\n<p>That was the outcome of Tuesday night\u2019s latest monthly meeting of the city\u2019s Board of Police Commissioners. When off-duty, employees of the Department shall not drink intoxicating beverages to an extent that it will render one unfit when reporting to duty. Employees of the Department are strictly prohibited from using any narcotics, exhilarants, hypnotics, hallucinogens, anabolic steroids, toxic drugs or controlled substances that are unlawfully&nbsp;administered.\u201d<\/p>\n<p>That\u2019s in comparison to the previous version of that same section, which read: <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>Employees of the Department shall not drink intoxicating beverages or use intoxicants in any manner while on duty or in uniform. When off duty, employees of the Department shall not drink intoxicating beverages to an extent that it render one unfit when reporting to duty. Employees of the Department shall not use or render himself or herself unfit for duty through the use of narcotics, exhilarants, hypnotics, hallucinogens, or other toxic drugs unlawfully&nbsp;administered.\u201d<\/p>\n<p>The revised policy also includes significantly updated or entirely new sections on random drug and alcohol testing procedures, <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>reasonable suspicion\u201d testing, recertification testing, return to duty testing, and the parameters of voluntary disclosure and employee&nbsp;assistance.<\/p>\n<p>And it maintains the department\u2019s prohibition on marijuana use. Even though the <a href=\"https:\/\/www.newhavenindependent.org\/article\/state_legalizes_adult_marijuana_use\">state legislature recently legalized adult-use recreational&nbsp;cannabis.<\/a><\/p>\n<p>The NHPD\u2019s prohibition on marijuana use comes in the policy\u2019s definition of <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>controlled substances.\u201d The policy defines that term as: <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>Any drug included in Schedules I&nbsp;through V, as defined by Section <span class=\"numbers\">802<\/span>(<span class=\"numbers\">6<\/span>) of Title <span class=\"numbers\">21<\/span> of the United States Code (<span class=\"numbers\">21<\/span> <span class=\"caps\">USC<\/span> <span class=\"numbers\">802<\/span>(<span class=\"numbers\">6<\/span>)), the possession of which is unlawful under Chapter <span class=\"numbers\">13<\/span> of that title, or any drug included within the definition of <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>Controlled substance\u201d in Title <span class=\"caps\"><span class=\"numbers\">21<\/span>A<\/span>, Chapter <span class=\"caps\"><span class=\"numbers\">420<\/span>B<\/span> of the Connecticut General Statutes (for example, including, but not limited to: cocaine, marijuana, barbiturates, amphetamines, morphine.) The term does not include the use of prescribed drugs which have been legally obtained and are being used for the purpose for which they were&nbsp;prescribed.\u201d<\/p>\n<p>Meares emphasized on Tuesday that the local policy distinguishes between drugs that are federally prohibited and controlled substances, those that are prescription drugs, and those like alcohol, which are legal for people above a&nbsp;certain age but can be&nbsp;abused.<\/p>\n<p><span class=\"dquo\">\u201c<\/span>Although it is now not illegal to possess cannabis in the state,\u201d Meares said, <span class=\"push-double\"><\/span>\u200b<span class=\"pull-double\">\u201c<\/span>it is not consistent with New Haven Police Department policy for officers to use that substance under this policy, and I&nbsp;just think it\u2019s important to highlight&nbsp;that.\u201d<\/p>\n<p>The drug-policy update comes roughly four months after Mears and Zannelli took the lead in comprehensively rewriting, and the police commissioners voted to approve, <a href=\"https:\/\/www.newhavenindependent.org\/article\/use_of_force_update\">a&nbsp;new version of the department\u2019s use-of-force&nbsp;policy.&nbsp;<\/a><\/p>\n<p><em>See below for the first five pages of the new drug policy.
