Under the cover of CBD laws, Bud Man charged \u2018$5,000 for 10 pounds. (There\u2019s no such thing as delta-8 flowers, it\u2019s usually hemp flower sprayed with D-8 distillate.) [<a href=\"https:\/\/fox59.com\/news\/national-world\/bud-man-stand-sold-cannabis-in-bulk-at-missouri-farmers-market\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fox 59<\/a>]<\/p>\n<h2>Legalization updates \u2013 is D-8 still legal?<\/h2>\n<h3>Federal news<\/h3>\n<p>Capitol Hill lawmakers didn\u2019t move any d-8 legislation in March.<\/p>\n<h3>State news<\/h3>\n<p>The <strong>Georgia<\/strong> Senate sent back a hemp bill to committee after lawmakers noticed language that would have unintentionally made delta-8 legal. [<a href=\"https:\/\/www.ajc.com\/politics\/georgia-senate-almost-voted-on-cannabis-product-without-realizing-it\/NBOGEPKJOBGZNNYM3TF6UUUZQE\/\" target=\"_blank\" rel=\"noreferrer noopener\">AJC<\/a>]<\/p>\n<p>Regulators in <strong>Illinois<\/strong> issued a policy statement that blocks licensed cannabis businesses from producing delta-8 or delta-9 THC using hemp oil. [<a href=\"https:\/\/www2.illinois.gov\/sites\/agr\/Plants\/Documents\/Hemp%20Cannabis%20Policy.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">via Marijuana Moment<\/a>]<\/p>\n<p><strong>Kansas\u2019s<\/strong> attorney general issued an opinion saying delta-8 THC is only legal if derived from hemp. Products containing it must not exceed 0.3% total THC. [<a href=\"https:\/\/sos.ks.gov\/publications\/Register\/Volume-41\/PDF\/Vol-41-No-09-March-3-2022.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">via Marijuana Moment<\/a>]<\/p>\n<p>In <strong>Kentucky<\/strong>, the Senate Agriculture Committee approved a bill to ban delta-8. By the end of the month, after conferring with advocates in the state\u2019s hemp industry, Sen. Paul Hornback, who sponsored the bill, asked legislators to hold the bill while he amended it so that it will only prohibit sales to those under 21. According to lobbyist and activist <a href=\"https:\/\/twitter.com\/CaptainKurtis\/status\/1504153929139081218\" target=\"_blank\" rel=\"noreferrer noopener\">Kurtis Hanna<\/a>, this ruling by the state\u2019s Pharmacy Board finally allows the purchase and possession of delta-8, delta-10 and CBD, though sales will have to be addressed by the legislature at a future date. [<a href=\"https:\/\/www.startribune.com\/minnesota-hemp-industry-applauds-legal-fix-to-cbd-question\/600156629\/\" target=\"_blank\" rel=\"noreferrer noopener\">Star Tribune<\/a>, <a href=\"https:\/\/hempindustrydaily.com\/minnesota-oks-trace-amounts-of-thc-in-hemp-products\/\" target=\"_blank\" rel=\"noreferrer noopener\">Hemp Industry Daily<\/a>]<\/p>\n<p>A bill introduced in <strong>Tennessee<\/strong> would further limit the allowed delta-8 THC content to 0.3%. [<a href=\"https:\/\/fox17.com\/news\/local\/tennessee-bill-would-further-limit-allowed-delta-8-thc-content-percentage\" target=\"_blank\" rel=\"noreferrer noopener\">Fox17 Nashville<\/a>]<\/p>\n<p><strong>Utah<\/strong> lawmakers banned smokable hemp and putting CBD in food, deferring to federal authorities instead, but delta-8 managed to emerge unscathed. The ban specifically excludes \u201cany cannabinoid that has been intentionally created using a process to convert one cannabinoid to another,\u201d which is how delta-8 THC is usually produced. [<a href=\"https:\/\/hempindustrydaily.com\/utah-bans-smokable-hemp-and-cbd-in-food-punts-hemp-oversight-to-feds\/\" target=\"_blank\" rel=\"noreferrer noopener\">Hemp Industry Daily<\/a>]<\/p>\n<p><strong>Virginia<\/strong> lawmakers passed <a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?221+sum+SB591\" target=\"_blank\" rel=\"noreferrer noopener\">a convoluted measure<\/a> that redefines marijuana in a way that\u2019s intended to regulate sales of delta-8. It was rewritten to broaden the definition of marijuana to include any substance containing a total THC concentration over 0.3%, which includes delta-8 and other related cannabinoids. A license would be required to sell it.
